Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and BlitFlow, an unincorporated business operated from Argentina ("BlitFlow", "we", "us", or "our") and govern your access to and use of the BlitFlow websites, applications, APIs, SDKs, CLI, MCP server, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and able to form a binding contract to use the Service. The Service is not directed to children.

3. Accounts

Some features require an account. You are responsible for the information you provide, for keeping your credentials and API keys secure, and for all activity that occurs under your account. Notify us promptly at hello@blitflow.com if you believe your account or keys have been compromised.

4. Acceptable use

You agree not to use the Service to:

• Violate any law, regulation, or third-party right, including intellectual-property, privacy, and publicity rights.
• Generate, upload, or distribute content that is unlawful, infringing, deceptive, defamatory, or that depicts non-consensual, sexually exploitative, or otherwise harmful material.
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems, or to probe, scan, or test the vulnerability of any system without authorization.
• Interfere with or disrupt the integrity or performance of the Service, including through excessive automated requests, denial-of-service activity, or circumvention of rate limits.
• Reverse engineer, resell, or misrepresent the Service, or remove any proprietary notices.

We may suspend or terminate access that we reasonably believe violates these Terms or creates risk or legal exposure for us or others.

5. The Service and preview status

BlitFlow lets you compose typed nodes into workflows and run them across our API, SDK, MCP server, and CLI. The Service is under active development and is currently offered free of charge while in preview. Features, models, availability, and limits may change, and we may introduce paid plans in the future.

6. Your content

You retain ownership of the inputs, prompts, workflows, and outputs you create or provide ("Your Content"). You grant us a worldwide, non-exclusive license to host, process, and transmit Your Content solely as needed to operate, secure, and improve the Service and to provide it to you.

You are responsible for Your Content and for ensuring you have the rights necessary to submit it and to use any outputs. Because outputs are generated by AI models, they may be inaccurate, may resemble other outputs, and are provided without any warranty of originality or fitness for a particular purpose.

7. Our intellectual property

The Service, including its software, design, node library, documentation, and trademarks, is owned by BlitFlow and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you here, we reserve all rights.

8. Third-party services and models

The Service integrates third-party model providers and infrastructure. Your use of outputs from those models may be subject to the providers' own terms and acceptable-use policies. We are not responsible for third-party services, and their availability may change.

9. Fees

The Service is free while in preview. If we introduce paid plans, we will present the applicable pricing and payment terms before you incur any charge, and continued use of paid features will be subject to those terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLITFLOW AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD 100).

12. Indemnification

You agree to indemnify and hold BlitFlow harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. Provisions that by their nature should survive termination will survive.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of Argentina, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to binding arbitration or a small-claims exception.
